From the fact that in general we chip the foliage which isnt classed as virgin timber.

(it does not include clippings or trimmings that consist primarily of foliage)

The key word is "Primarily" that means you can have foliage in but I read that as not more than 50% otherwise it is primarily foliage.

 

If it's good enough for Boi fuel it's not primarily foliage and the idea of composting is to reduce the amount of foliage to leave woodchip.

 

I will pay for a license when they drag me through the courts kicking and screaming and when they finally make it clear that tree surgery does not require one I will laugh my little cotton socks off at you lot that have given up and bought one at the first hurdle :001_smile:

For what it’s worth, I recon leylandii brash is likely to be primarily foliage and depending on the tree a felling could also be primarily foliage. I can’t imagine there are many contractors out there who don’t shift a load of “conny” chip at least now and again.

It still doesn't go to landfill and is sold, unless you like wasting money :001_smile:

 

I think in the case of Arbs, "waste" needs redefining if infact it has been defined :confused1:

I agree with Dean, but I don't really care whether I am right or wrong.

 

I still don't have a chipper so I pay to tip at a commercial site where it is mulched by huge machines and composted. In fact I always see my load mulched before my eyes.

 

Therefore by any definition of the word it is not waste, as I pay to have it recycled.

 

I see it as an unfair tax on my business.

 

If I was taking real waste to landfill, I'm not sure, still an extra tax, but not my problem.

 

 

Edit: Its stuff like this that is why my profit is 70% of turnover and not 20- 25 like some folk, it all adds up.

Don’t get me wrong here, I don’t have a waste carriers licence either. Several years ago on a wintery cold and rainy Friday teatime I spent half an hour explaining to the powers that be that woodchip didn’t need a WC licence.

 

Things weren’t as clear then as now and that evening and the ensuing exchange of communications with the EA made me wish I had just bought one rather than arguing the toss with a blinkered wage slave with rain dripping down my neck at the side of the road and plod offering to arrest me for public order when I told said wage slave exactly what I thought of him and the EA. (in industrial strength terms)

 

The point I was making is that, as you pointed out, the operative term is predominantly. I recon a load of “conny” top is nothing but foliage.

Never agreed with it. Never will. It's organic. It's not waste. I could pitch it in a corner and it would be gone in a few years, wildlife the better for.

 

Does anyone know what we're threatened with if we are stopped and refuse compliance?

 

Is it like the Tv licence, where if you don't have one they may or may not take you to court, may or may not charge you, may or may not fine you, and if they do alll of these the fine is only £200? :deal:

 

Are there any cases of prosecution that we know of? :post:

As I mentioned earlier these cost are quite reasonable '£140 for 3 years' (£95 renewal)

So £140 for nothing in return is reasonable??????????:confused1:

 

In that case please send me a cheque for £140 and I promise too send you nothing through the post, can't say any fairer than that now can I:sneaky2:

And also a real shame that this is another issue where the AA have just rolled over and said "yes what ever you prefer" too the powers that :thumbdown:
