Grade 2 Listed Building - What if different species of tree planted

Suppose someone got planning permission to change the layout of their grade 2 listed house's garden, and the site plan illustrated what species and location to plant this tree. But the owner then decided to plant different species of tree without consent, what implications would this have?

 

Especially if it were some years ago. Would it also affect home insurance (liability)?

If the species caused subsidence that the correct species wouldn't have, insurers might have a lot to say about it.

That's a breach of planning, not home insurance

But if the planning breach was said to have caused a claim against the ops home insurance the insurance company could use that to get out of paying a claim passing the cost back to the home owner, that could be a very expensive change of tree! Unlikely maybe but not impossible.

I had to submit a planting plan when we did our place which is grade2. As far as I remember when talking to planning at the time they want to see a plan to see that what you're planning generally fits the surroundings - in terms of general landscaping.

As far as the trees went nobody has ever been back to check they even got planted. They could have been planted and failed. It certainly wasn't an issue when it came to getting the place signed off. Gardens naturally evolve so how long does the original plan count? Unless you decide to plant a row of leylandii 2ft from your neighbours or an Oak by the conservatory I don't imagine anyone's bothered.

Was the garden actually covered in the listing? You can check online. Often it’s just external features such as windows, type of brickwork etc. 
 

If buying a property, an indemnity policy to cover you against the costs of any future reinstatement for stuff the previous owner did without consent is surprisingly cheap. So it’s really not a problem if buying a listed place that isn’t quite as it should be. 
 

The whole system is complaint driven, so a lot goes un-noticed.

Grade 2 listing will very likely only apply to the house itself, there isn't a definitive list of what is and isn't included it very much comes down to the local officer.

Insurance company won't look back at old planning details Ivery much doubt, but when the insurance was bought they would have asked if the house was listed, and if there are any trees within 20m/over 5m high etc etc, I'd just check the correct information was given to them as this makes up the policy?
