as above just a scenario. You turn up to fell large oak/ash whatever with cherry picker and four crew with truck etc. No TPO or in a conservation area. Two hours into job local tree officer turns up and puts a tpo on it So now your 700 quid down. Can you get any compensation from anyone. as I say just a scenario your thoughts please.

You should be able to in my opinion, but I highly doubt you actually could.  Thats a bit of a bum deal though if that actually happened to you

Under normal circumstances in 2 hours with all that gear you should be able to render the tree not worth saving.

We’ve had a similar thing happen. We ended up walking away. We got a little bit of compensation but nothing compared to what the job was worth.

Now, if I feel that there is risk of this occurring, I'll get a shallow gob into the stem and/or nick the buttresses. I do feel that the planning authority have had many years to become aware of the tree and if they thought it worthy of protection should have protected prior to it coming under threat. The T&CPA has been around for close on seventy years, so it's hardly a new thing and they're playing catch up.

Done this a few times, and once after I had just done it a local councillor turned up and started complaining about all the trees that were being felled in his area. He rang the Tree officer whilst we carried on and she told him that they weren’t protected and nothing could now be done.

He wasn’t happy! I did feel a bit sorry for him.

I bet a rash of new TPOs weren't made in the area, despite the councillor being concerned about the loss of canopy cover.
