  1. How could you possibly know that Ratty? Just because it's taken me 10 years to get to this stage doesn't mean it'll take too much longer! 10 years 'thinking time' then crack on! There are a few hiccups with the planning issues but we'll get them sorted and crack on now! Yome as bad as the Mrs always nagging about jobs, I said I'll do it by the end of Summer (I just didn't say which one!)
  2. When you do get the info mucker, make a note of it! You may need it again when you design and set to work a rainwater harvest / shower / WHB system for me. I'm erring towards a composting shitter so that won't need supply / septic and the grey water from shower etc can go straight on the garden. ????

Moving away from the ‘technical’ back to the original (what I interpret as) ‘moral’ question - should a TPO be initiated on a tree which, by declaration, will be approved for felling so as to facilitate conditions? It certainly appears (to me) to be a, perhaps well intentioned, over zealous misapplication of the spirit of the legislation. Thoughts - Objection raised to TPO, tree examined against TPO qualifying criteria, documentary evidence of LA being content to remove, TPO overruled, notice was served, 6 weeks has expired, tree is felled and no conditions may be applied.... I don’t think it’s a very smart (or appropriate) way of doing business not least of which because it has the potential to alienate a tree owner (who, anecdotally) might have been keen to re-plant anyway but now may be thoroughly disenchanted with petty administration overtly and unnecessarily issuing dictats and demands.

That's part of the point I was making earlier Gary writing a letter saying "shall be" isn't quite the same as notifying a TPO as "has been." - Notification - Wait 6 weeks - There is either a TPO in effect by the end of 6 weeks or there isn't - If no TPO in effect notice has been served, no TPO issued, no constraints are in effect and no replant (or any other) 'condition' may apply I guess if one wanted to 'play nice' (and it suited the diary) you could reply to DN and give a timescale within which you might be willing to await the TPO being presented.
  5. Which part Chris? Wait for it to die and then require a replacement? (was typing that before the next post came in with detail of the DN) So, 'shall be' is different to 'has been.' If the 6 week point arrives and no provisional TPO has been publicised can the tree be felled under s211?
  6. Mmmmm, and maybe if carbon footprint was attributed to point of consumption rather than point of manufacture we’d have a more accurate (and uncomfortable) appreciation of the source of the problem....

The art of the possible over laid by the harsh reality (esp domestic) A scenario which was presented at the recent tree architecture/.Morphophysiology seminar @ Barchams covered a situation where ‘apparently’ structurally compromised trees (2 previous, separate, consultant reports had recommended removal) were re-assessed applying a different approach and the culturally important trees were retained. 2 key elements to the retention were the more enlightened assessment process and, most importantly, the desire and commitment of the tree owner to retain the trees. I think it was a university so one would rightly expect the cultural, academic, financial resources to recognise and preserve the assets. Achieving that level of enlightenment in the domestic sector will always be a huge challenge ? PS - there are an ever increasing number of complete fruit loops on the various FB tree pages. Sheffield, Horse Chestnut Ave, netting etc seems to have energised the public - which is great - but it may be a beast that grows out of control!

In this case, I’m trying to reverse engineer or attempt to decrypt someone else’s AIA which ‘appears’ to present some iffy RPA calc’s with potential implications for building placement. Just can’t make the figures work from the existing detail and can’t fathom the methodology that has been applied (or maybe not) to arrive at these findings.

  12. If only it were that simple Eggsmeister! It may start as a sly tinny on the train after a hard days graft, but where would it end? Convicted criminals wearing a tag to the Palace of Westminster because they thought speeding laws “didn’t apply to them?” Jeremy Corbyn having a cheeky phat one because Dianne wouldn’t blow him off? Joe Public might be forgiven for such seemingly trivial transgressions, but the long term deleterious effects of the normalisation of deviation from those in such positions of public responsibility could have significant negative impact on civilisation as we currently know it! Today she’s knocking back a M&S premixed cocktail, tomorrow she could be main lining and The collapse of civilisation will be down to the sort of liberal, apologists like YOU and Mark!

So what’s it to be then? is it: (a) I’ll dispense with any laws I personally don’t wish to abide by or (b) I’m too important to abide by the laws which only apply to the ‘little people.’ A relatively insignificant example scenario but with some considerable implications from the nation’s Shadow Home Secretary.   15. Not 'exactly' a todays job scenario, but it was today that I heard that over 2 years from the start (Feb 17) when the client asked: Q "...could you do me an Arb Impact Assessment..." Q "...what's the situation and when do you need it..? A "...pretty much straight away for an appeal - the original application has been refused because I didn't have one..." So, after 2 applications, 2 appeals, the Town council and LA have been over ruled by the PINS. And local authorities wonder why there are so many vacant, suitable plots not being developed when the need so obviously exists. This scenario has been a terrible example of influence via Town council and Ward councillor at committee which has cost the land owner (and the tax payer) a considerable amount of money to ignore the planning officer's recommendation for approval and force the matter to appeal for a second time. The PINS judgement comes with a MASSIVE sense of satisfaction and it was a great conversation with the client earlier. The long fights are the best fights.... ??????

  18. Nuffin really, it just kind of rolls off the tongue and seems a suitable, if somewhat nondescript (bloody French, what have they ever given us?) sort of location. Maybe Leicestershire (near Fenny Drayton and Higham on the Hill) (52°33′42.942″N 1°27′53.474″W; SP 36373.66 96143.05) would be a better choice as the geographical centre of England*....? Could provide a better insight into the real opinions of the nation since the M25 bubble appears to be a planet all of its own? No.... I bet they are all lovely. ?

They should all be moved to a trading estate in Milton Keynes in a purpose built and fit for purpose building with barrack style accommodation on site. The savings would be immense!
