Never heard that before, if they refuse your app than as i take it you cannot fell it, thats why you put an app in the first place cos its protected in a con area. If you put an app in and they dont reply in 6 weeks you can go ahead.

Just spoke to a consultant mate and he said that they cannot refuse the works for a tree in a conservation area, they can only either agree to it or make a TPO. He said he would back it up if necessary with the various documentation.

 

If that is the case then surely there would be no need to even ask the L/A:confused1:

 

I am 99% sure(was a 100%) that what IC trees said is how it goes.

Just had an email from the client who is nervous, and I did just see that she is a solicitor. Mmmm me thinks I'm going to get that paper work. Will post here if I remember.

 

Why not do the simple thing and ring the tree officer and ask him, after all its him that makes the decisions!
