Parish council agree to fell tree - how to stop?

Yes but they still have to put in the notice. If the PC get the tree felled without putting a notice of intent up then they can be prosecuted can they not?

 

Oh yes it's still a 6 week notice alright, unless it's DDD then a 5 day notice.

So for the poster, the PC can't just fell the tree without putting a notice of intent in to the LA. The tree officer will then come and look and will either put a TPO on the tree or he won't.

 

Yep that's it in a nutshell hodge.

So in theory the Parish Council, assuming they own the tree, need to apply for permission to fell it because its in a CA? Or the arborist doing the work for them would lodge the application?

 

Please excuse my ignorance, as I've said before I'm not in the industry, sorry.

 

No, not application, but a "211" notification. As before, in a conservation area notification should be made, (unless you intend to make use of the dead and dangerous exemption).

 

The authority then has the opportunity to protect the tree with a TPO. Anyone can file a 211 notification, its a planning application, in broad context like any other regardless of ownership or any interest.

 

A couple of years back there was an example where a resident made an application to build in the garden of a supermarket boss because they made an application to build a supermarket.
