self employed how much can i work for one company?

I was under the impression that if you are self employed (Subby) you can only work for one company for 70% of the time? I cant find any written evidence of this on hmrc but its a damn complicated website.

 

Just wondering if anyone can enlighten me as to the rules for the amount you can work for one company? :001_smile:

There is no single test of self employment.

 

If you do the same days or hours regularly, then you should be paye, and if the majority of your time is spent working for one firm you should be on paye.

 

You may well get away with it, and it is your employer who will have problems with hmrc anyway. They are tightening up with the introduction of rti, so it probably won't be long before they crack down on "self employed" workers.

over rthe past 15yrs, I've never had an issue either being a subby, or now as the boss.

as noted if you are constantly working the same hours and days and exact same pay etc. then yes should be on the books.

but the way we get around this is we change our weekly work around, so this week is 3 days, next week is looking like 4days etc. etc.

and if you have your own work as well showing there should not be an issue

I think you will find you are wrong chap. I run all my own equipment. Over the last few months I have been doing a lot of subbing ( to a few different companies). But doing a lot for one in particular. They had their accountant in the week before last, he told them that they are sailing close to the wind with hmrc. We have had to change the way we are booking jobs in.

It looks like HMRC are catching up with the information technology age and are gathering data they can actually use. They can number crunch and check for trends so employers who use sub-contract labour only as a way of reducing their tax payments may find themselves being investigated.

Here's another one for you. I have just filled one in as a 'subbie climber' to see what came out and HMRC will have to get back to me regarding my employment status. As has been mooted on this forum historically, sub-contract labour has been a very tax efficient business model and HMRC don't appear to be too happy about this. It's always been a grey area in our industry and HMRC seem to be re-enforcing the boundaries of what is legal and what is not.
