My neighbour, Cupid Stunt as I like to call him, has just posted a letter though my door stating that he wants me to relocate my business:confused1:

At present I have my van in my space of the shared driveway. I have a double garage which is used to store my chipper, saws, trimmers and blah blah blah.

I do cut wood up and split with an axe for firewood only for my own consumption though. I do maintainance on Saturday after 10am consisting of a little compressor to blow the saws out. The odd saw may be started for a couple of minutes. But nothing major. Wood chip goes to a guy down the road.

I get along with all the other neighbours but thus guy upsets everyone, I guess it my turn:biggrin:

I suppose what I am asking is he right am I running a business from home?

In my eyes I only store my work equipment at home.

Don't quote this but not to my thinking.

 

Splitting your own forewood is just that. Starting a saw after 10 is fine.

 

It's the storing your work gear I'm not so sure on. Could just be taken home for maintance but I'm not sure on it.

If I have to get a yard to store my chipper and saws, my over heads and insurance costs are gonna go up, handy when your in your second year of business:angry:

The definition to make is running or operating a business

 

Running a business from home is an entirely lawful thing operating a business from home can cause problems.

 

Saw maintenance would probably be construed as business operation.

Like I said I'm not sure about the storing of gear at home. Is this your business adresse?

 

The use of saws, and starting them within the hours of day light are fine. So is doing timber for your own fire.

 

If you get a visit tea and biscuits are always good tho. :thumbup1:

There must be millions of people in uk who have works vans and equipment stored at home, builders, plumbers, electricians etc, this sounds like you have a grumpy neighbour, hope you resolve it all ok, and in your favour.

Part of the answer is whether you make a claim for the use of your garage on your tax return as business premises. If you claim it as half business usage then you probably are running it from home. The maintenance is dodgy as that is business activity.

I'd just ignore him, but if he complains to the council, you might get a visit, so might be worth thinking through your story.

 

This advice is totally worthless and as I have little money I am not worth suing (see other thread)

Chap I know had same situation, chipper saws etc stored at home, neighbour complained and he ended up moving his stuff elsewhere, not sure if due to legality of running a business (is a ltd company so may be different rules to self employed?) or just for an easy life
