Evicting birds for a clearance job

Afternoon all,

Opinions please....

So a certain council has asked us to fell some trees and leave them before the birds are nesting. This is for a major house building firm. No word of a bird survey at all. Now I thought we had come into nesting season and this sort of thing was frowned upon. What should one do in such a situation, when the council officer is telling you to get them down???

As long as you don't come across any or intentionally disturb you will be ok BUT make sure you check the site before and make/keep records.

The maximum penalty that can be imposed for an offence, in respect of a single bird, nest or egg is a fine of up to £5,000, and/or six months' imprisonment.

Some birds nest all year like pigeons and the nesting season changes depending on climate etc. SOME RARER BIRDS HAVE MORE PROTECTION

The council maybe telling you to take them down and that is fine, they are not telling you to disturb destroy etc .

We have had this problem before contacted natural England re checking for nests. in the opinion of our local officer we had to show that we had made our best effort to look for nests this involved staking out the trees and observing the comings and goings of any birds along with a binocular survey and finally climbing each tree and most importantly recording the results
