Have you now heard of talking? Just pointing out the error of his ways may have been enough to put an end to it. You don't need any sort of authority to do that, do you?

 

Well continuing with the devils advocate........

 

He is a jobbing landscaper on a paying job, I don't see how any words would have stopped him till he was holding the folding.

Worth reading the HSE press release

Unsafe tree work leads to fine for Lincolnshire man

lists and explains the regulations he breached.

Also says his employee was also using a saw without training or PPE, may explain the fine a little more.

 

theyv only prossicuted becoz they had a quilfied witness had it been joe public/not quilifeid in treework as such would thy have been as keen to go to court ????

That's what I was just thinking - more to the fine that just the boss up the tree with a chainsaw.

No-one likes a snitch, but I am surprised at many of the responses in this thread.

 

How many posts have I read that whinge about being undercut by unqualified and un-insured outfits?! Yet, here we have someone that really should have known better (as a professional gardener he can't claim ignorance) taking unnecessary risks doing the job that we have all trained hard to do well.

 

I think the HSE have done the right thing here - it sends a message to workers and the general public that this sub-standard work is not acceptable.

I'm interested in the idea that the legal action taken is disproportionate because the guy could only have hurt himself... How much does a couple of paramedics, ambulance, a casualty team and hospital services cost if things go wrong? I have no idea but I doubt its free - there is a cost to society for his increased risk taking.
