As said above check they have it in writing and confirm with the owner also if its a large ash at a castle id be checking for tpos and conservation area!

I would certainly through it back in there court saying you assumed the big ash was protected by a TPO and seen as they had not provided a letter stating otherwise then obviously you could not fell the tree.

id go visit the castle owners and see what there response is before getting a saw out

surely if this was the case they would have told you specifically about the castle ash being ok to fell.

They would have said 'take down this row of ash and include the ash on the other side which although it's in the castle grounds has been OK'd for felling- here is the paperwork'

This does all seem odd, reminds me of the other recent thread about having someone else's tree cut down.

If this tree is not within the boundaries of their property and they did not expressly ask for it to be felled then any normal person would not assume it was included. I would politely explain that you aren't expecially comfortable with the situation, offer to knock 50 quid off for prompt and final payment and don't deal with them again...!

Say you will take it down but will need to keep the wood - at least you can claw something back that way.

 

I would make sure you have a copy of the approval - don't want a court order landed on you as well!

The castle owners have said it is fine but i have just been on the phone to the council and as i expected the castle grounds and the tree are part of a conservation area . which is fine but the guy isnt going to hand over a penny until i have done the large ash. And now he is refusing to contact the conservation department to get permission.
