the whole thing is a mess, without a doubt.

 

the 7.5 tonne + sector used to be a big mess with exemptions = xy& z etc. that sector seems to be managed well & the few rogue operators are dealt with,

 

the 3.5 tonne will go the same way, it is inevitable.

 

i know it will cause hardship, some arguments etc but if it keep the roads, our towns/villages & our families safe then its not such a bad thing...

 

20 years ago drink driving & speeding where more socially acceptable than they are now...... lets face it, time to move an... overloaded transit with a chipper in tow that has never had its brakes looked at isnt going to stop quite as quick it is maybe should..... IS IT???????

Amazes me how these various agencies expect us to keep trolling the internet to find out the latest regs without directly notifying any operators at all, then say ignorance is no excuse!

Land Rovers (and any vehicles with four wheel drive) are classed as dual purpose vehicles and - under current legislation - are exempt from operator licensing

 

Therefore, there will be no need to add this vehicle to your licence.

 

NB: You should contact the Central Licensing Office in Leeds, where you wish to add a goods vehicle to your operator's licence

 

:D would that apply to my ford ranger day cab too? I could tow a trailer for work purposes and not need an O license?

 

And other thing. Would carrying goods for a job count as hire and reward? Such as grass, plants or taking arisings away?

Sadly it probably is inevitable if we all took that attitude, although judging from some of the replies I'm not sure it would cause hardship for everyone.

 

But why stop at 3.5tonnes? Why not make it 500kgs and daily checks, that should keep my family safe. Ah, but only if the high risk under 25's were limited to 10mph and then perhaps in 2015 make it under 45's limited to 5mph. Before long we could legislate accidents out of existence!

 

Where will it all end? When do we say enough's enough? I'd want to see the data which proves the population is being annihilated by Transits which don't operate out of an approved centre before I stopped fighting against operator's licences for 3.5 tonners.

Abolition of the small trailer exemption

Paragraph 3 of Schedule 1 of the Goods Vehicle (Licensing of Operators) Act 1995 exempts from operator licensing a ‘small goods vehicle’ forming part of a vehicle combination (not being an articulated combination) where all the vehicles comprising the combination excluding any ‘small trailer’ have a plated weight not exceeding 3.5 tonnes.

A small trailer is defined under the Act as a trailer with an unladen weight not exceeding 1020kg. This trailer does not need to be included when calculating the 3.5 tonne limit.

However, under the Regulation all the vehicle combination (including any trailer) operating for hire or reward must be included when calculating the weight limit, so the small trailer exemption will be abolished for hire or reward operations from 4 December 2011. However, the small trailer exemption under paragraph 3 of schedule 1 of the Goods Vehicle (Licensing of Operators) Act 1995 will remain in place for operators carrying goods other than for hire or reward.

So does the above mean we can continue to use our chippers, also trailers (small) just for use but not using the trailer for log sales etc.... hire reward...

Is not your chipper just another tool of the trade? You don't hire it out and you don't get a reward for using it just as a tool for the job. A bit like a saw?
