Hi , I have applied for felling a group of TPO Ash trees with die back. The relevant council has changed its tree officer who does not reply to emails and will not call you to discuss. I have been waiting over the statutory 6 week period. Do I now have the right to fell them legally. Any advice will be fantastic.

if you still haven't heard after 8 weeks, apparently you can appeal it

2.1 Grounds of appeal

An appeal against a Council’s decision may be brought against any of the following:

  • the council’s refusal of consent
  • any condition attached to the council’s consent
  • the council’s refusal/failure to notify the applicant of their decision within 8 weeks from the date they received the application, (in these circumstances the application is deemed to have been refused)

tpo you cant cut without permission. unlimited fine.

 

That's my understanding too, Conservation area is a notification and the time is six weeks. TPO is a planning application and the determination period is 8 weeks, after which you may appeal, not carry out works.

Your appeal should be made on the relevant TPO (consents) appeal form obtained from PINS. You may also obtain a form.

A word version and a Pdf version are available (Please note for the PDF version you will need Adobe Professional software.)

When using a word version where possible please can you save the copy as a PDF before returning to us

It's not a planning application. It has its own statutory rules. It is application for 'consent'. Planning is an application for 'permission'.

How did you apply via the portal or on paper ?.

 

Things like that automatically raise application numbers including going through levels of checks before it even gets listed on the council system.

 

It should be visible even if it has to go through committee etc.
