Might be a long shot, if he is a Certified Arborist, might be something in the new ethics code, if not might be worth fighting fire with fire do a similar feature in paper and state you are the original - use it as a campaign to explain to clients that you are not to be confused with ...

Legally think you only have to change something by about 10% before there's nothing yo can do

TBH most of us spout the same old blurb anyway.

 

I may set a new trend this year with some brutally honest spiel.

 

-Mediocre service

-Average tree work

-Fully qualified staff (unless we're a bit short)

-Rough tidy up with as much as possible blown under shrubs etc.

-Surly, hungover staff with grubby clothes

-Dirty truck

-Broken gutters tacked back on, aerials fixed with sparky tape etc.

-Pretty young daughters ogled at

-Free quotation (I'll just up the price if it takes a bit of effort)

-Unseasoned pop, willow and conny logs supplied

A woman (nieghbour to a job) Kieth was on was a bit upset about a little conny clippings going over her side, I didnt hear the whole thing just when she said "I've never been so insulted in all my life"

 

To which this guy replied " well you wanna get out more often luv!" seriously, true!

 

Unbelievably hes been in business for 30-40 years! I helped him on a job once, the client says to me that Kieth only got the job because she simply had to meet the guy who would have the gaul to call a woman stupid on the phone!

 

He called her stupid as she couldnt assist in him quoting over the phone when he asked is the tree dinner plate sized or saucer sized!

 

UNREAL!

if you have already published this advert, i think you DO have a leg to stand on.

however it is a personal legal battle you have to chase.

however, i do recall someone saying to me its a different kettle o fish if they have copied web content off you. i think this is the one place that the web self regulates pretty well.

if they have copied you and have published it as their own, their web host has to remove it.

problem is how do you find out their web host is. (and how much money you are willing to give to legal people!)

Was told by a trademark lawyer that if you took it to court it would cost you 20 thousand in fees for starters and anything up to 200 thousand if it went to high court.there is companys on the web where you can register youre name for £82.00 a year if anybody uses your name or trademark they will do the legal work for you.
