  1. 👍🏻 I'm too stubborn for my own good but can't change what's in my DNA! I'd happily buy a round of drinks for a group of strangers if the whim took me (that's rare by the way!) but I'd fight the barmaid to the death if she short changed me 10p! Generous to a fault when choosing what to do with my money, but I'd rather burn it than have someone try and tell me what to do. 😡
  2. No mate.... I've had a guts full of it! I'd be ashamed of myself if I had customers telling me how to do my job. I'm going full on to get the mug I've had to deal with sacked. I'm keeping a record of all the "decisions" he's made that I've had either an apology from him for being wrong or have had turned over at tribunal. I'll do time for this before I pay a single penny that isn't scrutinised first.

These are the nuts: BS Embroidery Plus I've had rugby jerseys that are 3 years old and still pucker - some printed, some embroidered, some knitted "old school" style rugby shirts, some the more modern "breathable" types. I've got t shirts in a breathable fabric, a goretex jacket with branding. You name it, they'll do it. It's a small family (husband, wife , son) outfit local to me. No hesitation recommending them.
  5. extract of latest correspondence: Dear Mr X, to follow up on the telephone conversation yesterday relating to wether training courses are a valid inclusion as a trading expenditure, I forward the following information in support of the position as I interpret it: It is a legal / statutory requirement that suitable training be completed prior to using a chainsaw. In addition to the general requirements of the HaSaWA 1974 “All people using equipment at work must be adequately trained to ensure health and safety in its use, supervision or management” and PUWER - it is expressly and specifically stated by the HSE that chainsaw operations require additional training as specified links provided below. Training and competence - Work equipment and machinery http://www.hse.gov.uk/pubns/indg317.pdf Chainsaw qualifications are further subject to mandatory, time specified “refresher / update” schedules in order to comply with the legislative requirement. You stated as justification for disallowing training courses that you “considered” them inappropriate due to the uncertain nature of their value to the business? I am confused by the logic you appear to be advancing since, for example, a tool may be considered as a deductible expense but there is no way in which to quantify the “value” a tool might bring to the business nor the “life” it may be used for. HMRC’s BIM42526 appears to me to be absolutely clear. BIM42526 - Specific deductions: administration: own training courses “Provided it is incurred wholly and exclusively for the purposes of the trade carried on by the individual at the time the training is undertaken, expenditure on training courses attended by the proprietor of a business (either as a sole trader, or in partnership with others) with the purpose of up-dating their skills and professional expertise is normally revenue expenditure, which is deductible from the profits of the business" In the face of, what appears to me, to be an overwhelming weight of evidence to support the position that training costs ARE an eligible deduction, and since you have presented only that which you “consider” to be the position, I would greatly appreciate any links to HMRC policy or documentation upon which you have based your consideration. Wether this is brought to relevance in regard to our discussions of historic circumstances, or as it may bear on future tax returns is equally relevant and I appreciate your written statement so as to establish a record of the subject.
  6. Jules, I just re-read the recent exchange. To clarify, I wasn't asking if there was a right to abate (no question or doubt there) but rather, how does a highway situation allow the financial burden to be passed from the party being encroached to the party causing it. Not sure if I articulated that properly?
  7. Thank you Jules. It doesn't seem to clarify the issue of placing a charge if the authority does the work though. Would you say that might be something that has "evolved" as a recognised practice on the basis that failure of the tree owner to act after notice could result in prosecution and that placing a charge is cheaper / quicker than prosecution?

  11. Maybe a TO could offer some insight ..... Assuming a person suffering an encroachment / trespass has a right to abate the nuisance and assuming there doesn't need to be notice given of the intent to do so (although it might be considered neighbourly to do so) and assuming, whilst that right exists, financial liability for abating the nuisance lays with the person seeking to abate it, how is it that (as appears to be indicated in this example, and seems common) the council can require the work to be done or undertake the work and place a charge against the hedge owner? Is this peculiar in some way to trees / hedges causing an obstruction to highways?

  13. Would you consider replacing "trespass" with "encroach?" (not being picky, just trying to be correct in my thinking - if trespass is correct and encroach incorrect please do say so!
  14. Interesting and perhaps an obvious initial thought, but, I'm not sure a TPO would offer the protection it might warrant? It's encroaching and causing an actionable nuisance - in the eye of the council (if the report is an accurate record.) Can a hedge / tree be grade 1 listed? Don't know?? Put some bat boxes in it, that might do the trick....

  16. Bullying bar stewards trying to bash the little man whilst cosying up with the corps. I'm dealing with a cretin that can't read. I've sent him documents as requested, he's misread, misunderstood and misrepresented what I've sent. I've corrected him, he's acknowledged and apologised, then repeated his previous misrepresentation. I've then corrected him again, which he's acknowledged and apologised for, then..... Guess what.... Done it again! On 1 issue this cycle was repeated 4 times! I have neither the time, patience nor temperament to politely tell "an expert" how to do their job but I will not roll over and give in despite the hassle and stress.
  17. 👍🏻👍🏻👍🏻 The swear filter and the lack of available expletives in the English language leaves me similarly short of an appropriate description! I've just turned them over at tribunal and am now going to higher tribunal to drive the knife in as far as is possible. Then will follow the request for disciplinary review and, hopefully, sanction or dismissal for the cretin I've had to deal with. I know it's an open source, and I really hope you're reading it, you know who you are 👊🏻

Evening all, I'm engaged in some Interesting conversations with the accountant, HMRC and a local training provider over the issue of wether training courses are deductible as business expenses or not. HMRC are saying no, accountant has to check the detail, training provider was pretty swept up and gave good examples of some that is, some that might not be and some that is, apparently, a grey area. I'm just starting to look into it and have yet to arrive at any sort of amateur assessment. I've found this: BIM42526 - Specific deductions: administration: own training courses which I have yet to read & digest. Have any of you had any dealings with this issue on journey of business development? Do you include training courses (examples would be awesome) in your operating costs for tax return purposes? As an aside, is it any wonder HMRC are getting such a universal bad press? Dame Disaster should be publicly flogged and all her seat polishing minions should be hung up by their test tackles.   21. Perhaps it's just the way I read it..... My interpretation was, "I have an Oak tree ( a job I don't know how to price)" Perfectly possible I misinterpreted it....? So, if answering a question for a tree / home owner seeking a price to do a tree task, there's a range somewhere between 2 likely lads from down the pub with baler twine and a Trago chainsaw who'll do the job (of a fashion) on a Sunday asking only the wood for payment, right up to a professional outfit with suitably trained & experienced staff, appropriate equipment and safety mechanisms potentially including TM at around the £500-800 mark. Either way, it seems likely that some butchery appears imminent.
  22. So now, gently, it's emerged that it is your tree. Are you a tree worker or are you seeking a view on the sort of price you should be expecting to pay someone to do the work for you? I did wonder why some questions were being answered, some not so much....
