  1. Where's TCD when you need him.....? Chatting with a neighbour this morning. Something of a typical rambling, general conversation which brought us eventually to the subject of strip of plantation forest which was straddling the boundary and fell within the ownership of the person I was talking to and his neighbour. It seems that, originally, the linear planting scheme had been executed in the wrong location due to a mapping error which meant it was the wrong side of a boundary fence when originally planted. The owner at the time didn't mind (no surprise) and didn't require it to be removed. The correct planting scheme was then implemented the other side of the boundary fence - net result, double the intended area of plantation with equal areas either side of the boundary between the 2 neighbouring land owners and a boundary fence running right through the middle. So, one neighbour has recently had his area of the plantation clear felled. The obvious result is that the pre-existing boundary fence which previously formed the centre line of the whole plantation now forms the edge of the plantation that remains. All of the remaining trees - those that were previously in the centre of the plantation and significantly sheltered by the opposite half - now form the outside edge with all the prevailing weather. You'll have guessed where this is going.... Trees that were in the centre of the plantation have not acclimatised to prevailing weather and are being bashed over by the wind in significant numbers. So the question - does the landowner that has clear felled, and adversely affected by his actions or omissions the status / value of the remaining trees in separate ownership, owe a duty of care to the landowner that hasn't? If yes, would it be reasonable to expect that the difference in value / cost of extraction of the windblown area, as compared to if it was valued as standing timber without obstruction / complication be a reasonable basis for estimating the "loss / harm / damage" incurred by the the land owner that hasn't clear felled? I should imagine this wouldn't be a unique or particularly uncommon scenario in commercial forestry but it's not something I've ever considered. Any advice or opinions from forest dwellers most welcome - (insults, ridicule, humour and sarcasm equally welcome if it serves to brighten our day!)
  2. Any chance of a look at the letter? What exactly are they stating as the infringement or activity that they claim requires a change of use from / to?
  3. It was a touch later than I'd planned to leave but had intended to stop in Launceston en route for a TPO app site visit so dropped that and made it to the auction just in time. Went a bit mad with the bidding card though and had to make a return journey with a second trailer! Still didn't get it all loaded and have to return again tomorrow!!

  5. That was the case Saturday morning Gary whilst trying to find a farm auction sale up near St Clether! Satnav + postcode = useless! Auction sale signage = useless! Pick up + long trailer x proper tiny tracks, fords, cattle grids, idiot drivers = high blood pressure and very short fuse!! 💣

  8. Like gaining a reputation for getting the job done (within the appropriate rules and regulations) and challenging nonsensical constraints imposed by poorly informed or over enthusiastic bureaucrats - like "conditions" on a S211 notice for example....
  9. Repetitional damage? With who? Not the (or future) clients - certainly not where it is the LA that has a pre-existing and broadly recognised monumental repetitional, efficiency and effectiveness confidence deficit with the general public. And down here!
  10. Result! I knew someone would spot the hasty (pre edit) error!! The natural 'follow-on' question from the 'planning conditions apply to the land and it's owner' position though (and perhaps of greater interest / relevance to us tree cutters) is - Contractor cuts down tree at request of homeowner. Contractor checks prior to cutting for CA / TPO / FL issues but doesn't check for planning conditions. Tree hits the floor, neighbour or LA kick off about planning condition. Implications for tree cutter = nil (relax, count £'s, enjoy cold beer.) Implications for home / land owner.....?
  11. A planning condition would only apply to the person granted planning consent... 🤔😳😁 Options.... 😂 (PS. For the pedants (I include myself!) and on sale or transfer of the land, possibly to the new owner)

  13. I'd welcome the prospect of a self driving pick up with dangerously over loaded trailer... It couldn't possibly do a worse job than the mentally retarded, FWs I encountered on the road today whilst returning to collect a load of granite from a farm auction.
  14. It's as much about knowing "people" as it is about knowing trees.... Where common sense, decency, tact, diplomacy and even legal process fail, there's always an alternative course of action.... Once you know "people!"
  15. They may not be interested in OP's plight because it doesn't effect them. Get ½ dozen cockerel (or some other method of choice) that will negatively affect the neighbours enjoyment of life. When they come round to complain, bingo, there's your trade off! Or kill them and bury them in a shallow grave....

  17. I'd tag that as a brave, forward thinking, innovative, "good news" initiative. That's what national governments should be doing, setting long term strategic head marks. Industry (and public opinion / consumption) can plan, adapt and exploit future opportunities based upon known policies. Maybe a consequential shift away from dependence upon unrefined oil, and a whole scale adjustment of foreign policy in the Mid East may follow? A brave new world!
  18. Be better feeling the hysterical women! Would be good to get some balance. If the trees were scheduled for felling anyway, surely it would be deceitful to wait til after the judging??
