The question really though rather than was it or wasn't it a crack was were does the duty of care lie in similar situations? I'm gonna refrain from trying to learn VTA for the mo:lol:

Who would the duty of care fall under in this situation? Sorry no before pics, just thought it would be a normal job! Went to thin these two A. pseudoplatanoides this morning (the one behind being a 4 stemmed tree) and i was up the single one at the front. One of the tree inspectors happened to be on site to give the go ahead on the work (thin) for the tree i was doing as on the sheet the 5 stems were only down as one tree (they were quite clearly 2), anyway, as i was climbing to start work i noticed this hazard beam crack (possible banana type crack), and told the inspector (who wanted to retain the tree) that i could do with a reduction rather than thin, to alleviate some weight off the cracked limb. He argued that it was a crack in the bark (even told the client) and that nothing was wrong with it, it definately wasn't just a crack in the bark as you could see cracked wood, it did not go through to the other side of the stem though. Where does the duty of care lie if this tree/limb were to fail?

as the moth is from southern europe is there not a natural predator there that can be introduced here to help eradicate the pest? would the introduction of an outside species be ecological viable and would they even survive here? would they then cause a problem themselves once (if it worked) the OPM outbreak was under control or eradicated?

oh yes! thing is though, if i admit:blush: that day was filled with good and bad karma... we helped the guy, and the nurse i asked for help at the health centre was well fit (and i couldn't stop pervving!) I am only red-blooded you know!

me and my mate helped an old man (80ish) who had fallen and whacked his head on the pavement, my mate sat with him while i ran to the local health centre (round the corner) for a nurse and to ring an ambulance he had an egg sized lump on his forehead and blood everywhere but in the end he was fine coz we helped:thumbup:
