If everything is less than 75mm dbh it's excempt, but I've always emailed the LA to inform them that we are doing it and everything is exempt. An email saves them responding to a complaint and coming out, then stopping everyone working while they look round the site.

 

A bit of professional courtesy and may earn you some brownie points.

 

Correct.

 

Although i dont agree with brownie points, its just a better more professional way of eveyone getting on with thier work without hassle.

The council is responsible for highway clearance so you need not worry.

 

The 75 mm relates the the stem of the tree and not creation of 75 mm wounds by limb removal.

So what's the limb removal max size? Thought it was all the same

The statutory duty on highway clearance is the LA (basically). Whether they do it themselves or tell the landowner to seems to vary, but is up to them. I've had owners who have been told to do, within 28 days, in CAs, where the planning department have said you need to submit a section 211 notification (maybe get an answer within 6 weeks)

Basically the 75mm exception rule is to allow small insignificant self seeded trees to be removed.

Thats how i think of it.

As Gary says anything else as far as work on trees of a larger dbh than 75mm would require notification regardless.

Unless another exception applied, but there is only specific senarios where this is the case.
