Dont employ anyone as its a pain in the rrrs. Build good relationships with your self employed team, pay them fairly and show them respect and you'll have a winning setup. Just get your self employed contracts sorted properly!

 

 

Please explain about self employed contract?

The "75%" and written contracts are probably meaningless as you've put your cards on the table by calling them employees.

 

No, no, no you've read it totally wrong.

 

I have 3 employees not including myself. so they are under contract anyway.

 

However i have 2 subbies that are contracted to us for 1 day a week each over a 6 month period. It guarantees them work and myself the knowledge that the jobs can be completed when booking work in x amount of weeks ahead.

 

As part of this contract it is made clear i am not to be used as their only employer as i cannot offer them full time work and they take responsibilities for themselves finding other work.

 

It mainly covers me as freelancers can be douche bags!!! for instance not turning up for work. This allows me to invoice them the full amount of their day rate plus any additional costs ive incurred.

 

I got fed up with these all rock-star wannabe climbers wanting top dollar and basically me being the only one screwed out of money if they double booked or forgot, even sleeping in. It always seems the guy whos finding them the work and investing money in kit to make their life a bit easier seems to be the only one loosing out.

 

Its just my experience as a contractor that if your not tough you could go bust through no fault of your own.

One day a week is part time employment, as they are then not free to choose what work they do on that day.

 

Not saying don't do it, but I don't think that's self employment. If you have employees already then it should be easy to employ these other guys as part time?

True, but the solicitors did contracts to keep them self employed. Plus they said something about it becomes they have 2 jobs and extra tax.

 

All above board and not illegal.

does it really matter & who actuley gives a flying frog :biggrin:

 

If you are an employer happily treating guys as subbies and you get a letter from the hmrc to pay back years of ni contributiona tax etc. Or you have a guy take you to an employment tribunal claiming unpaid holiday pay or even unfair dismissal. you might..
