MY insurance told me i dont need EL insurance for my son has family next of kin are covered and that the chance of your son is going to sue the arse out of you are nil/

That's completely bogus

 

The criteria for the requirement for Employers Liability COMPULSORY insurance (ELCI) isn't the chances of getting sued are nill.

 

If a family member does work for the company some benefit must accrue, weather its wages or the general benefit to the family business. This peer relationship is a well established principal in the eyes of the HSE and that's what counts.

 

As Steve says, managing a life changing injury needs a lot of money and the only people with pockets that deep are insurers.

If they are being paid you will need EL. The grey area is very much where immediate family members are 'helping' but I would echo what Steve said; if the worst happens then they will need looking after so best to be covered.

Ok thanks for all your time in answering my original post. These are my quotes I received yesterday via my local broker.

 

 

Cover Summery 1

Insurer: Aviva

Public Liability: £1,000,000

Tools: £5000 (Covering James & yourself)

Plant: £0

Employers Liability: £0

Total Annual Premium = £195.80

 

Cover Summery 2

Insurer: AXA

Public Liability: £1,000,000

Tools: £3000 (Covering James & yourself)

Plant: £25,000

Employers Liability: £0

Total Annual Premium = £434.11 (increase of £238.31)

 

Cover Summery 3

Insurer: AXA

Public Liability: £1,000,000

Tools: £3000 (Covering James & yourself)

Plant: £25,000

Employers Liability: £10,000,000 (1 Labour Only Sub-Contractor- employed by Trees2Go)

Total Annual Premium = £590.

 

Still need one without the plant but with EL.

It seems as we are father and son, him being fultime and me being part time he does not need EL as I am a family member. I am doing a course for CS30 to help.

I have only just started my buissness and i was told that i wouldnt need employers liability but now i know i actually do like you say probly better safe than sorry, Thanks for the advice and sorry for the false information in the first place...

 

Open admissions of being wrong are so rare on forums, this deserves a mention. :thumbup:

Does Ariva and axa actually do arboricultural and forestry?? I used to be with Direct line before i started the tree surgery side and they couldnt take me on for covering tree surgery as it was too high risk for them. Check the small print and also work at hight limits??
