Doesn't sound all too competent too me, could very easily have toppled the Mewp too.

 

Without knowing any more detail we can't definitively say who's responsible, but the climbers methods sound unorthodox.

So how long before all climbing is deemed 'not the safest method' then? Reading that piece looks like it already is!

 

So what comes next, hold on while I consult the crystal ball - a recurring trend of MEWP accidents as the arb industry abandons climbing in favour of MEWPs, regardless of the conditions and suitability of that equipment....

There is little to be gained by picking over the bones of REPORTED actions

 

The salient point for me is that the fact that the HSE prosecuted the main contractor means they consider the responsibility lies there.

The employer is usually ultimately responsible. Be that the customer, the contractor, or any sub contractors. Each have a duty to ensure that the people they employ act safely and are suitable qualified etc..
