Nesting birds

I need a bit of advice. How does the law stand on dropping a tree and then discovering a pigeon nest with chicks? Obviously it isnt practical to climb and check every evergreen hedge, cedar and hawthorn we fell but dont want to end up on the wrong end of a hefty fine!

Technically...... an infringement of the Countryside and Wildlife Act ( intentionally—

(a)kills, injures or takes any wild bird;),

 

but.....

 

In the greater scheme of things, if this bloke can walk free from court:

 

Farmer who earned £283,000 from illegal landfill site walks free from court - Wales Online

 

it's unlikely you'll be getting the dawn knock.....

 

After all, this bloke didn't even face a trial, just call it collateral damage!

Its a tough 1, i never intentionaly drop a tree if i know a nest is in it but u cant be held as deliberatly harming a bird if u have no idea its there surely! Will have to check the legislation but im not dragging my ass through every leylandi to check!

 

Yes you can, the legislation was change a while back, you have a responsibility to check, same goes for Bat's.
