Using a chainsaw in a public place

Just out of interest how would an individual stand in the eyes of the law if he/her used a chainsaw without suitable PPE, without insurance or training in a public place with no warning signs etc?

If the use is commercial the HSE are going to have an issue with the lack of PPE.

 

There is no requirement for public liability insurance but many public event organisers will insist on it.

If the activity is commercial it must meet the HSE's requirements for PPE HSAW etc.

 

If they are part of a community organisation that's going to be commercial but if its just some random bloke cutting stuff up in public there isn't much that can be done legally.

 

The land owner can insist they conform to safety standards or stop

hmmmmm an individual that took it upon himself to use his chainsaw to cut fallen wood in a public place for his own gains (the wood). An argument could be made that it was being done free of charge for the community to clear said branch.

If he is doing it for the wood its hard to see how you can make a case for community activity.

 

If he cut the timber off the path and left it all behind then I can see that as a public minded venture but is wont take it into the HSE's remit (if that's where you are going with this tack) unless he is instructed by the LA or some sort of community body
