If you could prove that there was a valid reaon for not wearing anything but a thong then so be it. PPE is best practise not law. Its the same old argument.:bored::001_smile:

 

Yes it is best practice. But if the HSE want to prosecute you they will do it as you are breaking a statute law, and this is a criminal case.

To complete a criminal prosecution they have the burden of proof.

To prove you were doing something wrong they will look to statute laws with associated Regs, and to ACOPs and to industry guidance.

The H&S@W Act 1974 requires you to do what is "reasonably practicable" to ensure H&S during your activities.

IMO do not rely on advice given on this or other forums, in relation to your obligations. You can all see we have different interpretations of what we have been told.

Take time to look at the PPE Regs, LOLER, MHSAW, PUWER, COSHH etc.

And in my own words take or leave that advice:001_smile:

I dont understand this Blakes, surely you are talking of your duty of care towards employees and the general public.

 

Surely, if a female customer want to pay me £10K to cut her tree down but do it naked, then that is my own problem if I get injured, but if I ask my groundy not to wear PPE then thats breaking the law :confused1:

Was you avatar taken on a typical day? Or were you in all your fancy gear for an assessment?

 

I was busy testing out my new CE compliant 'Aussie surfer look' coordinated PPE rig on that massive takedown.

 

Unfortunately the 36" bar on the 66 wouldn't quite merge the back cuts, and that photo was taken whilst waiting for Jerry Beranek to fly in with his 090 sporting a 7' bar.

 

Just then HSE rocked up.

 

Been pulling pints ever since....
