advice on a kestrels nest

iv had a look at a conifer that has failed into another tree where the is a kestrels nest

im well aware of rules etc of nesting birds and the fines

what i want to no is if the failed conifer is a heath and safety risk what can i do what are the channels i go through to remove this conifer

my main aim is not to get in trouble

I'd guess Natural England would be the place to start.

I'm thinking of putting 2 5ton ratchet straps in to the 2 trees to brace them together lower down now as they are birds of prey I would rather leave them alone

Iv never bin in a place where I may have to take a tree down with a nest in and just wondered what to do and where to go

So any links or info would be great

Yeah could you make a temp brace to hold it in its current position, then once Kes has buggered off crack on with the job? Contact Natural England's licensing department though, at least call them.

Try, try, try and hold off. The kestrel is now struggling in this country. There has been a pretty huge decline in numbers from what i have read

Be careful if you temp brace not to leave yourself liable if it fails.

If possible, move any moveable targets, heras fence the whole lot off and wait a few months.

Ditto that, if there are no eggs or chicks, and if the tree poses a significant danger, then it would be ok to destroy the nest, keeping natural england informed.

Proving significant danger is important though, as others have said if there are alternatives, i.e. bracing or cordoning the area off these could be explored. Whatever you do keep natural england / local wildlife officer in the loop.

Speak to the local RSPB, they might be able to offer some pointers or advise on where or who to speak to
