Hi guys so just wanted to hear what you thought, but won't go into to much detail as he's a member on here.

 

So i buy aspen via a arbsuppliers website. i get the conformation emails saying they've received my order, then another saying its been ordered and will be with me at the end of the week.. Great stuff..

 

After TWO weeks i finally make some calls and find out that nothings been ordered and I've been lied too. i as for a refund so i can take my business else where (Saturday just gone) and still haven't received it.

 

I paid via paypal have have put a dispute against the seller indicating a refund but no answer still. so i email the company and no replies to any messages left..

 

 

So today i was looking at a saw selected the bar and delivery type and it went from 500-600 pounds to 8 ?? with delivery 20 pounds..

my thinking is bloody well buy it, so i did again paying via paypal got the conformation emails again, only to receive a final email saying my order has been refunded and nothing else..

 

Am i in my right to take this further since the saw etc was at the price shown on the site but they refused?

With regards to the saw, it is Contract Law 101. Quick crash course in what makes a contract coming up. You need offer, acceptance, consideration and intent to be legally bound. All 4 elements must be present for a contract to exist. You may think that the advert is an offer to sell but in law it is what is known as an invitation to treat. The offer in this case is your offer to buy the saw at the wrong price, which has not been accepted by the seller and so no contract is entered into. The case giving the precedent is Fisher and Bell (1961) IIRC. :001_smile:

ok just thought it was like walking into a shop. see some milk on offer "buy 1 get one free" then you get to the counter and its full price for both. they would have to sell the goods as advertised

 

Nah! Shops sell at the price that it should be, not at the price it's marked up at.
