Ok with all the info this happened last November why not do something about it then instead of waiting until now ? If it was such a problem. If it was my house I would have got them to replace the tree then .

Are you going to replace the tree and shrubs if it gets taken from deposit ?

Personally if you are selling it a few things come to mind.

 

1.they probably cut it down because it was making the front room dark. I wouldn't replace it. Just remove the stump and just charge them for that. New owner will want to put a stamp on the place let them choose.

 

2. Put a few small shrubs in to ease the sale. Bill them for those.

Mature vegetation is a proven asset to property and it is also proven to de-value property, depending on the circumstances.

 

This can be true BUT the decision to remove it belongs to the owner NOT the tenant.

Thinking you have the right to do something doesn't mean you can .....it is no defense in law to claim that you thought you could do it

 

 

The law all over is weird and it is open to interpretation if ya put 100 lawyers in a room you'll get may be 101 different opinions :lol:

 

 

Why don't ya go see a legal eagle as well they are supposed to know the law and will be able to advise on if it criminal or civil and what the procedure is and how to go about it. It may also cover your ass in the long run

whether you will get a penny for it will all depend on the wording of your tenancy agreement, and even then if the ammount isn't agreed by the tenant then it will be decided by the adjudication service (depending where the deposit is held), and from bitter experience the best of luck if it goes up that route.

That's why you would be better going down the Criminal Damage route. That has nothing to do with the deposit. Of course, it would only be polite to point out to the tenant that it would be a good move on their part to settle up before it got that far. :001_smile:
