Potholes damage

My wife was driving along a back road this evening in the dark and hit a pothole which was out from the edge of the road. It has smashed two alloy wheels, written off 2 nearly new tyres and we think damaged the front suspension. Car has had to be collected by recovery truck and will be taken to main dealer tomorrow. Have spoken to insurance and they think we are covered. Anyone know how we stand regarding claiming against the council for the damage or is that the problem of the insurance company. She was not speeding (I can vouch for that as i was passenger) and was doing nothing wrong.

go back to the pothole before they conveniently fill it in, take plenty of pictures and use something to scale it like a ruler or similar, pictures dont lie (or so they say but I seen some dodgy looking ones) The council are covered I had to claim once, normally I wouldnt have bothered but had to, good luck.

I was told you need photo evidence too?

 

I've had several pothole incidents over the last 3 years, Must of caused a total of a grands worth of damage! 2 new alloys, damaged suspension mount and lost count of how many tyres! :thumbdown: Guaranteed by the time I've got back in daylight or road dried to get a decent photo the hole has been temporary filled!

If they have been notified that the hole exists then yes you can claim off it.

 

Getting them to admit that is another matter.

 

Get pics use a scale.

 

For future reference the lines are that if they have not been informed of the hole before the accident then there is nothing they can do. As if they don't know about it they can't do anything about it, and they are only responsible for they hole after they have been made aware.

Some years ago, a similar thing happened to a good friend in his Lancia Delta 4x4. Tried to claim but it was thrown out as "if you didn't see it, you were going too fast, "....

 

Understandable comment but it was dark and filled with water so looked like a puddle!
