I would like to see the delivery offence appear in court !!. Must be the only organisation in the country to be discouraging the use of renewable fuel. I wonder if national laws and regualtions are above local bylaws ?.

 

Others have covered the smoke cont area aspect, to burn wood in a smoke cont area the stove needs to have DEFRA approval. No Defra approval and only smokeless fuel can be burnt. When the stove is signed off as being safe by a suitably qualified person a copy of the sign off certificate gets lodged with the local building inspectorate. So they know who has a stove, what make and model it is ( and DEFRA publish a list of approved appliances) and who has installed and signed it off.

 

So its pretty easy for the authorities to see and check on non approved stoves as to their fuel usage. Burn wood in a non defra stove in a smoke cont area and you usually will be prosecuted.

It does not need "signing off".

 

My brother installed his own approved stove, his neighbour saw him stacking logs in his garage and companied to the council.

 

The man from council came round, my brother showed him the cert for the stove, the guy from the council was happy and that was the end of the matter.

I don't think thats right somehow. On here someone linked to a page explaining size of log, and what sort of appliances can burn wood in a smoke controlled area, it listed every one. I don't remember it mentioning defra either. Kirklees is a backward county/area in some respects, and this is one of them. Of course you can deliver logs there, after all how else would the people with approved stoves get their fuel? Carrier pigeon? I dont see how delivering to someone with a non approved stove can incriminate you. That would be like suing the car shop for unknowingly selling the car to someone with no license.

But they say "most wood is treated releasing heavy metals into the air". Now unless i'm missing something i just saw my logs split bag and sell. I think this is more Big Brother. i'd like to see them arrest someone for that. Saying that if it was our local police force they be on you like a shot

Virtually all of Kirklees is designated a Smoke Control Area and it is illegal to emit smoke from a building if the smoke is caused by the burning of unauthorised fuels such as wood or coal. Wood or coal can only be burned on an exempted appliance or alternatively smokeless fuels should be used. The delivery of wood fuel in a Smoke Control Area is also an offence.

 

Interesting to see a regulation that appears to contradict itself - and probably invalidates itself in so doing.

 

According to that wodd burning owners are going to have to collect??

I had a few phone calls from a ldy before Christmas enquirying about a delivery of logs. She was moving in to a new house and having a stove installed. The last call I had from her, she asked if my logs were smokeless!!!!

 

Whilst I was dying to say, "Yes, as long as you dont burn them!" I suggested she telephoned the company she was spending a lot of money with and ask them if the stove was DEFRA approved. Never heard back from her.
