A small problem with the neighbours

We had a new LPG condensing boiler fitted a couple of months ago, we have got elderly neighbours who have concerns about the "smoke" coming out of the flue, this so called smoke is actually steam and is known as pluming, we have spoken to the heating engineer who fitted the new boiler and read the spec on how far the flue needs to be from any openings, the flue is almost twice the distance away than is required for current regs, but the manual says that the flue must not cause a nuisance, is steam coming out of the flue causing a nuisance ? what is "a nuisance"?

the boiler is in the same place, but our old flue was 12" from our back door, beside it on the wall, we had to fit a vertical flue to the new one as the current arrangement was not within current regs, so instead it goes up through the roof. we are in a bungalow, our neighbours have a dormer extn, and its nearly four metres from the flue to their nearest window. the flue looks like a chimney (better than a swan necked pipe jutting from the wall and pointing upwards we thought), but the mental idea of a "chimney" with "smoke" coming out has caught her imagination, and worried her. the regs say 2m from below a window and 600mm from beside one. theres only the nuisance thing outstanding. dont think she realises this bit but not long before she does.

 

the old flue was out of sight out of mind to her, an old boiler dubious at best and though we serviced it it used almost double the gas the new one does so double the emissions.

 

by the way, egg has absconded to the pub so its mrs egg here, - men!

 

if there are typos, blame my other man Gordon, and his mate, mr shweppes.

 

if you ask egg hed say he has a very good idea of what a nuisance is....

What the manual says is what the manual says. What is more important is what the law says.

 

A nuisance in law can be anything that unreasonably interferes with the peaceful enjoyment of property, it can further be merely a nuisance where no legal redress is available “de minimis non curat lex” (the law does not concern itself with trivial things) or it can be an actionable nuisance where some form of legal redress is available.

 

Providing your flue is entirely on your property you are in the clear.

 

The steam may be a nuisance but it’s not actionable, but the elderly can be prone to worry, have you explained that it’s just water vapour?

thanks quip, i know some EHO's through work (sewage - we know nuisance if any one does) and hope to test this one on them, but as work as a water co we "get it" so to speak we're easy money to any authority, domestic stuff is different. i hope this is seen as trivial, they need some one they trust to alleviate their fears i think, they swear its smoke, but wont have it its only begun since the cold weather.
