Windblown TPO tree

Just been to see a 30ft windblown lime which is leaning against/over a house. Done TPO tree's and windblown before but not together, so a few questions if anyone can help please.

 

1) Phoned the local council, no answer at this time of night. The tree is rotten at the base and snapped out. Can I crack on in the morning after taking plenty of pics to prove its dangerous? Is the tree even still protected by a TPO if its like this?

 

2) I know that if a TPO tree is taken out unlawfully it needs to be replaced like for like. Is this still the case with windblown trees or is it a case of once its out its out?

 

Looked in all the usual places for these answers, but can't find anything. Any help would be appreciated.

Can be removed if its dangerous, but i would take lots of photos to cover yourself, or just give the TO a ring in the morning and let them know youre doing it, they will then advise you further.

Its up to the TO as to wether whey want it replaced, IME they generally do.

As, effectively, this is a 'dead, dangerous, dying' exempt item there is an automatic requirement to replacement plant.

 

Further remember the 'burden of proof' is on you to demonstrate the tree was 'ddd' if challenged by the LPA rather than for them to show it wasn't...hence lots of piccies.

Get plenty of pictures then get job done safe as said before replanting is normally a requirement if the tree officer sees pictures and has any commonsense then they will that the tree was dangerous and diseased drop them an email tonight to explain what has happened then they will see it when they switch on there computeramble !
