  1. Sorry for being pedantic but is this quoted from a legal document or just someones opinion?
  2. Do you know what this process is? As far as I am aware from 'The Town and Country Planning Regulations' a notice has to be served on the owners/occupier of the land by naming them and giving them a copy of the TPO. Otherwise its not worth the paper it is written on. Does anyone know of any written legislation which means the LA can put a TPO on a tree without doing this?
  3. The client has just bought the adjoining in which is why the trees are in an unruly state. And the land in question is a back lane which has a right of way through it, so I believe this to be why nobody has ever claimed it as it would be a legal nightmare for them to procure it without some argument from someone. I'm still very uneasy about undertaking the work as this just looks like a legal disaster waiting to happen! A further question if anyone can help, if they council are wanting to put TPO's on the trees who are they going to serve the TPO's to if there is no registered owner of the land? My client has done a very detailed search and there is no private owner so I suppose its either Crown land or common land, can they serve TPO's on this type of land?

  5. This is what is worrying me to be honest. I guess I being the contractor am the one who is liable if there is a title owner and they say, find me 5 semi mature Beech trees and put them back as they weren't yours to take down?
  6. The LA have asked the client (today) to withdraw the notice so that they don't have to TPO the trees and can come to agreement about the trees without a full blown application. So they def haven't put TPO's on them (yet). As for the unregistered land, it is something I am very unfamiliar with so am more concerned about. All I know is that the land is not registered with the Land Registry and the client has checked that the local council, highways agency and surrounding landowners don't own it. Apologies for my ignorance but what is IACS SFP5? many thanks
  7. A client has put in notice to the council to fell 5 Beech trees in a conservation area, and replace them with a Beech hedge. They are doing this as the trees should have been maintained as a hedge in the first place and now after years of neglect are way out of control. It is 6 weeks to the day today and the council have been on the phone asking for them to withdraw their notice and meet on site to discuss the trees as they see them as having a lot of amenity value. And also the fact that the trees are on unregistered land. 2 questions about this: If the 6 weeks is up, am I right in thinking that unless the local TO sticks a TPO on the trees overnight then we can go ahead with the work tomorrow? (I know that talking to the planning department is probably a better solution so a hypothetical answer is all I'm after) And Has anyone any experience of felling trees on unregistered land? Is it a no-no, or is there no comebacks as the land is not registered? Any help much appreciated.
  8. Just been to see a 30ft windblown lime which is leaning against/over a house. Done TPO tree's and windblown before but not together, so a few questions if anyone can help please. 1) Phoned the local council, no answer at this time of night. The tree is rotten at the base and snapped out. Can I crack on in the morning after taking plenty of pics to prove its dangerous? Is the tree even still protected by a TPO if its like this? 2) I know that if a TPO tree is taken out unlawfully it needs to be replaced like for like. Is this still the case with windblown trees or is it a case of once its out its out? Looked in all the usual places for these answers, but can't find anything. Any help would be appreciated.

  10. While we are on the subject of TPO applications. Submitted my first around 6 weeks ago (using google maps for my sketch plan), the time scale they give me to get back to me was around 6 weeks. How long can they take if they start dragging their heels about it, could i be waiting a while??
  11. You'll not find much cheaper than that if your 26 and dont have any no claims. Sell your tipper and buy something that can pull a tipping trailer is my advice.
  12. Unless you've got a 4x4 forget it Brent. I'm in Alnwick and have just spent 3 hours digging my van out and its still going nowhere, the snow was half way up the doors in height, must have been a good 3ft at least. Got 4 tree's to do and some logging in Morpeth, but with the A1 constantly shutting getting there is going to be a problem.

  15. totally agree with this. I've been asking anyone and everyone every question in my head for the last year. Got myself a decent file and started storing info about quotes, insurances, chipper/stump grinder hire etc. etc. etc. You get the idea. This will be invaluable when you start a business plan. Some people will help you out and give you good advice. Others will see you as competition and be an arse, shrug it off and keep asking. Write yourself a good business plan with someone like business link, and make sure you know your competition and what they charge. Get a business loan or grant for all the gear you need so you know you can do jobs and not have to turn them down because of lack of equipment. Stuff will pay for itself quickly enough. Only then would I send out C.V's to sub into other bigger companies, to suppliment your private work. This is only my opinion of course based on what I've found around this way.
