Also the courts will take the position of the individual into account and ask whether it would be reasonable for that individual to have known an offence was being committed. .

Thanks for your input Tony, always nice to get info from those with real experience of the other side of the fence so to speak.

I personally think the reasonable thing is key.

I do not think it is reasonable to expects the employee's of a firm, who may have only been given a job sheet that day or have been taken to site that day, to start asking to see paper work or making calls to the LA.

Personally I would not work for any firm I do not trust, so would never find myself in a position of having to double check or asking to see paper work.

Always, always get authorisation in writing/email. Several times surgeons have been told to stop work when a mistake has been made in the planning dept, they make mistakes too. Over the phone is ok but back it up to cover yourselves, your guys and also the customer.

Do you mean to get written permission from the TO that there is no tpo on the trees?

If so thats surely a waste of there time and paper!

Besides what if a tpo is put in the tree in the mean time.:001_smile:

So its best to call just before doing the job, then what If I dont believe them or its a mix up.:confused1:

No wonder some firms dont bother and just sneak on with it.:001_tongue:

:

If you have an email or fax confirming you are clear to go that's all you need. Thats one sheet of paper. If the TPO is put in the tree, don't look up.
