back away and leave the tree unless its a major hazard to a property or people.

 

There is a good chance the owl will already be sitting on eggs as they nest early.

 

If the tree needs to be felled ASAP then i would seek advice from the local Natural England office, about getting dispensation to carry out the work as its NE who enforce wildlife and countryside act legislation.

Contact the client, assess the Heath and safety implacations of the tree work, perhaps fence of the danger area until owl has felged and moved on, then reduce the tree to a safe standing stem, leaving the nest site (unlightly to be higher in the tree than 8-10m) where possible and or erecting an Owl box.
