Waste Transfer Licence

To be honest this may come out worse than it sounds I dont no but yes, We take it to a yard where the landowner there burns his 'waste' and allows us to do the same, but weather he has a liscense to burn it or not im not sure. He is a pretty big landowner so I presume so:confused1:

Probably shouldn't really be doing it but you'll probably get away with it, unless someone complains.

So Away from a waste carriers liscence for a second on this same site there is a massive coppice woodland but when people have fires to burn the tops in there how is that different to burning anything else barring tyres/plastic etc?

If you remove arisings from site it is classed as product or waste. If it is to be used again its not waste. If you take it away to burn, its not product, therefore you should have a waste carriers licence. Only trouble is, you cannot burn waste, so therefore you shouldnt be burning off site.

You can however get an exemption to burn on site, but you cannot move it to another site, i.e. it must not be transported and must be untreated, vigin timber.

Has that made it clear as mud:001_rolleyes:

Not according to the EA, they told me to apply.:001_tongue:

Believe it or not whoever you spoke to at the EA is wrong, BUT this is not the first time I have come across regional offices inconsistencies, variations and 'dud' information being supplied to contractors enquiring, indeed it prevails. We have a definitive, well as much as they were prepared to, from the EA National Policy Team...na, na, nana, naaaaaa....tee hee!

I think someone mentioned previoulsy the EA lady they had a 'good time with' (or simialr) was vague and said it's a grey area and hey if there's confusion to be exploited, particularly on their side, then go for it..just get it in writing in case you have to 'prove it' at some stage.

Good luck..!

So we DO need a waste carriers licence Paul??

Hi Mozza,

Frustratingly 'YES' I would strongly advise you obtain a WCL. Not all circumstances surrounding what you do will require one BUT many will and at £140 for 3 year licence with £95 renewal (I think) we insist on it for ACs.

Obvioulsy it's not for me to dictate to you, AND I can't say 'yes' it's a clear and absolute legal requirement, in the same way 'Employers Liability' insurance is (IF you employ people of course!), but I can quote you 3 separate waste reference nos. for woodchip etc. and bore you with details of previous correspondence if you wish....but "not tonight Josephine" as (cue violins) I've been sat in front of this bl**dy thing since about 7.30am this mornin n I need a beer.

Cheers..

Cheers pal, I was going to get one anyway over the summer, Ive always thought with this kind of thing, Its better to comply than look for loopholes/ways round it, As one day it will bite you in the arse, Like you say, its not expensive AND it ticks another box!

My 2 cents

Paul, why would you say we should have a waste carriers licence to carry clean virgin timber when the EA clearly states they do not view virgin timbers as "waste"?
