bs 5837 fines

evening guys

looked at a large pine on a building site today oh my god .

Bs 5837 out the window.

future home owner asked for my opinion before he buys.

about 100tons of subsoil banked up around it no protection fence site agent informs me that they have still to scrape 3ft of the ground level.

all this on a mature pine no more than 20ft away from a plush new build ?

 

i educated and told my customer that this tree will need removing within the next few years

and this would then be at his exspense.

 

my question to you lot is what is the max fine the development company could get if i blow the wistle on them ?

MIght be a to obvious Answer but sure the new owner of the house could get the monney back from the tree work you have taken out plus whatever court/solcitor fees apply.

 

Like I said im not sure but just what I would imagine.

 

The prospective buyer takes the property as he finds it or as advised by his chosen professionals.

 

The buyer should ask the developer to remove the tree as a condition of the sale.

agreed but im sure he can put a bond or something like that on the tree, i remember from college that you can put a bond on the tree and if the build company harm the tree in any way they face damage costs or can be taken to court to pay a fine per branch, cant remember the exact details

A bond is a surety of performance or payment. No builder is going to entertain that idea unless you own the tree and they had to.

 

Many builders won’t be around in a couple of years and many run sites as a limited company and wind them up when the build is done so a bond wouldn’t be my choice. I would go with a retention sum or remove what is probably a doomed tree
