cutting hedges or trees bordering public roads or bordering verges which border public roads.

 

It seems clear to me that this means when the vehicle in question is cutting trees or hedges, i.e. a tractor with a hedgeflail driving on the highway cuttign hedges that border said highway is fine using red diesel.

 

It does not mean that jonny tree surgeon can use a mog to clear up the debris from tree work done by chainsaws just because the trees happen to be alongside a highwway. In that instance the mog is not doign the work, its merely taking away the debris, which as I understand it, is goods so red is not allowed.

 

This debate will run and run, and until the authorities know the legislation themselves, there will continue to be "grey areas":thumbdown:

 

Im basically with you on this though Rupe, as i understand it, a mog(for instance) with a MEWP on it or chipper can travel to, and carry out operations (when on highway work) on red.

 

BUT, if the mog is used to transport chippings or timber away, it must be on derv

can you guys not reregister your mogs as plant if agri is a problem similiar rules on red and transprting goods

however it is clearly defined as a machine with sole purpose other than transporting goods

some hiabs are registered as this aswell as some cherry pickers i think

same as a combine if is cutting a crop it can run on red if however its carrying grain in its hopper its white

 

BUT combines or other harvesters (8.6 Agricultural engines) are NOT tractors (8.3 Tractors) so carrying stuff is not a problem ;)

The only authority is HMCE and they do know the legislation. The only grey appears when someone gets stopped by an authority with no remit to examine the fuel who can then say they got “puled” and the fuel wasn’t an issue. If HMCE stopped them (using derv of course) and they had no brake lights they wouldn’t get prosecuted for the offence but similarly it wont make no brake lights OK.

 

No to the tractor/Mog with the chipper, yes to the tractor with a flail.

 

No to the Tractor/Mog with a MEWP, unless it is large enough and suitably modified to allow it to use an exemption intended for mobile cranes.

 

Smaller MEWP’s must use DERV unless engaged in street lighting works which allows them to make use of the road construction vehicle exemption.

They are actually the authorities i was talking about. The last time i was stopped by VOSA, HMCE dipped my land rover then asked if the chipper behind was deisel and wanted a sample.

 

I told him it was, AND running on red, but when i asked why he wanted a sample, he couldnt answer, then walked away

And the last time I got dipped (Nov 09 at a farm sale) the chap doing the deed had recently had refresher training and knew the rules chapter and verse.

 

I wouldn’t say the officer I met was typical and I don’t think the officer you met was either.
