?‍♂️ he asked her but she just walked away, never even spoke, he asked her twice actually but to be ignored the 2nd time was even more rude than first. Its done with now anyhow.
Does that mean Doobop needs to offer his trimmings to the awkward neighbour too then, or are circumstances different with it being a tree?

Legally he has to, but when they decline its his responsibility to dispose of.

You have the right to cut back both the roots and branches from a neighbours tree to the point of the boundary but if you make the tree unsafe and it causes injury or damage, you will liable.

You can't throw the branches back over the fence as this is deemed as fly tipping in law but it is customary to offer them back to the owner. This is a bloody old law where the branches may include fruit and in those medieval days, would have had more value.

This is based on what I learnt many years ago at a previous property.....the neighbour was known as "Bell End"....coz he was!!!!

Hey Gary, What happens if after being side pruned, the tree becomes unstable with the weight only on one side? Or disease and decay entering into the tree through inter-nodal ‘boundary cuts’ Would there be any liability issues on the part of the contractor or would that fall to the owner?

There will be opposing opinions on this.

Can I answer tomorrow when I can use something better than my phone?

I took great delight in having this conversation with a retired police officer a couple of years ago.

He was so confident and authoritative, informing me that it would be criminal damage, and that I absolutely did not have his permission to touch his cherry tree. "I know the law, I was a policeman for thirty years!".

I politely informed him that there wasn't a problem, since I didn't need his permission, and the landowners were well within their rights to have his tree cut back to the boundary, but I could bring the cuttings round for him if it would be helpful. I didn't get an answer to that one, and disappointingly didn't get so much as a filthy stare as I cut his tree back to boundary.

I'm not sure why I get a twisted pleasure out of annoying people who try to tell me my job...

Recently wrote a report on a cypress lifting a driveway. I recommended seeking legal advice but included some of the options available to resolve the problems.

The owner, a retired Police officer who resolutely refused to acknowledge any problem, got a copy of my report and had the tree out that week.

I like helping people,  but get a little twisted pleasure when the owners being a right twonk

Basically bullies who've spent their lives telling other people "How it is" and don't like being on the receiving end.
