Unauthorised tree work in CA.

Down the road from me a birch is being dismantled (I quoted for it but was too expensive apparently), no tree work application submitted (home owner was told CA needs application at time of quoting). Anyway another company is currently doing it, I spoke to them saying this has no permission. He responded by saying it has a Co dom stem so can have a retrospective done on it after removal. I am annoyed at his blatant ignoring of CA rules, debating passing on photos to the council. Opinions please!

It is frustrating if the LA don't pursue contraventions, but what can you do?  

 

I know now a number of TOS and Planning Officers who are sick of doing their jobs properly but feel that it's a waste of time when the legal department won't pursue contraventions. Maybe if the revenue earned from prosecution came back to the LA to replace lost amenity instead of disappearing into central government coffers, the attitudes might change a bit?

If owner knew about CA and proceeded to get tree removed, that's a clear-cut wilful destruction, with unlimited fines. Unless the tree work was "urgently necessary in the interests of safety;", the co dom stem is a bullshit excuse and the owner would have to prove it retrospectively.  

 

It's up to you if you report it, depends on how much you like trees , how much you would like the industry to be properly regulated and and with less chancers and cowboys and whether you care that the Council is unable to enforce the laws that our parliament made on behalf of society. I know what I'd do, but I'm not a contractor any more so I don't care if I get a reputation for giving a s%$£.

Just swallow your bitter little pil and move on (nothing to see here! [emoji23]) just out of interest how big was your quote? Could just be a lesson in pricing the job... 
Price was £650 (no vat) , for 40ft birch dismantle, massive monkey puzzle 60ft crown lift/deadwood removal, shrubs trimmed and other small saplings removed including roots. Including CA application.
