Hi all,

Have an issue with one of our tenanted properties in which a neighbours twin stemmed birch leans right into tenants garden (see pic below).

Obviously legally we can cut back all overhanging branches to the boundary and I assume the same applies to stems where they overhang? I.e. if we cut back to boundary one of the stems would be left as a 1.5/2m stump effectively.

Thanks in advance!

What ever size it is you can cut it back to boundary, but maybe better to reduce over hang by thinning just to let more light in which would be better for the tree and keep neighbor happy.

Looks like a pretty secluded area for the neighbour and undesirable location for yourself? Would the neighbour allow you to remove it completely?

I’m sorry but disagree. That means that the tree would gain a right to trespass or encroach over anothers land if abating the nuisance caused harm to the tree?

Inverted commas? What source is that from?

I'm always nice, if a bit firm. I'm genuinely interested to know if there is a source somewhere that Arbs are quoting from. You might have guessed I disagree with it, but I am curious nevertheless to find the motherlode of tree errata.
