 It all depends which type of plod attend the scene, if local plod turn up probably not a lot. They just tend to sort out the clean up and go calling it an "accident". If traffic plod turn up the shit will definitely hit the fan and the charge sheet will probably be as thick as a phone book.

Agreed. You have to be pretty foolish to not measure your load and look out for these things. 

 

It's of course a can of worms but high profile cases (not this one) can draw attention to this area and one brush can tarnish us all. Being purely subjective you can say:

 

You can take a 17 old kid who's only ever driven a Vauxhall Corsa. Put him in a tractor that doesn't receive any independent safety testing, attach a trailer which again is not  independently tested for safety. Stick a 15t excavator on the back and off he goes. Plus he could drive 20 hours a day 7 days a week.

 

Compared to HGV use for moving the same kit it looks pretty haphazard.

I would be less worried about the Rozzers (that's not to say he shouldn't be worried about them) than I would the Stasi from Network Rail!  

 

Any fines or penalties imposed by the beak (if it goes that far) will pale into insignificance compared to the compo Network Rail could demand if they are minded to.  I forget the £rates but it's calculated by the minute for any train affected by loss of availability of the network.  So that's any train directly delayed on that line at the time, any connecting train that is delayed as a consequence of any other connecting train etc etc.  Very quickly the domino effect can have National implications.  

 

The Rozzers and / or HSE are going to be minnows in comparison to the damage NR can impose on anyone found to be culpable.

When a friends double decker bus hit a bridge and the main London Leicester rail line had to be closed for inspection the rate from memory was 30K an hour going back to the 1990s.  More recently a local farmer had cattle stray onto the line,  2am they get hit by a freight train, line closed for the carcases etc to be removed,   his insurer the NFU settled a claim at around £1 million for that plus the cost of the dead cattle.

 

That line is going to be closed for months, hope he is well insured.
