where there is a ditch at the side of a road, the ditch can be interpreted as the boundary.

Previously had a large lime at roadside, also in Essex and the County arb said that as it was on the far side of the ditch, it was the adjacent landowners responsibility.

I wasn't aware of that; a sizeable ash just a smidge outside the sheep mesh bordering the grazing where the other half keeps her horses, recently came down in high winds, straight over a busy country lane. At a guess a £500 plus bill must have landed on the landlords doormat. Sounds like same scenario - fence, ditch and road and I'd assumed that the fence was the borderline, not otherwise. Are you 100% on this?

I would disagree with that.

The LA might like to think they’re the law, when it suits them, but they actually aren’t.

That makes me feel like a blonde Judge Dredd :D

I can't speak for any other LA, but the Records Team where I work (@ Oxfordshire. Fabulous people) are really thorough and if there's any doubt as to ownership, they'll put in something like "on balance, we believe...".

You'll love my recent shopping trip:

Guns, bikes n' lube ? (all on the girlie duvet to show them off)

I'm surprised it's taken this long to go off-topic. It's usually achieved within the first reply.

What surprised me was that the landowner did not question the decision. It may be worth asking the local highway authority where their verge ends: fenceline or centre of ditch?
