TPOs and Climbing Only

Does anyone know if you are legally allowed to climb a tree with a TPO? Do I need to fill out an application to 'carry out works' on the tree with the LPA? 

 

I have no intention to carry out any work on the tree it is solely to climb it and check the fissures etc. for any bats that may be present (I have a bat licence and relevant climbing tickets).

 

I understand that wilful damage to a tree with TPO is illegal but does this therefore include climbing of the tree?

Reading the discussions on other forums regarding TPOs and the use of air spades and hand excavation, to establish the presence of roots I'm of the opinion that the definition of 'wilful damage' would really be up to the individual officers of the planning authority, in the first instance. 

 

But, personally I'd crack on in the knowledge that even if there was a claim of wilful damage it would, probably, be laughed out of court - if the legal team couldn't see sense before that stage.
