Is arboriculture agriculture

I have just read that agricultural waste is exempt, on the environ agency website. Then on the HSE web site its class' arboriculture under agriculture. Does that mean we are exempt?

I see what your saying but the HSE just bundle industries together to make life easy for them. I.e there are lots of cross overs between ag and arb so it makes sense to use the same investigators/advisors for the two industries.

 

If you were approached by a EA Enforcement officer and all your Arb work was carried out for domestoc customers. I really can't imagine the Ea's EO will go along with the agricultural waste thing. If however you soend all day every day working in the local farmers woodland you have a valid point.

 

But just because the HSE put Arb under agriculture I doubt it would stand up, The EA will want to know where waste originated from.

And if it's all going to be recycled at the old local bio mass generator? Basically i've been asked by a contractor on the olympic site for a waste transfer license, I've said we don't need one, but he needs proof. I went for an AA pre members course and they put the argument that arborists didn't need the transfer license. Can you clarify this? (everything is recycled)

All my chips go to a farm where they let it dry out then spead it on there fields so i would laugh at some one telling me i need a waste license. How do i need a license if its not waste which clearly its not its a by product from my work which is recycled brownie points huh.

My chip is the same, goes to the farm and is used to fill gate hole ruts or spread on the land. The logs are also given to the farmer as payment for use of his land.

 

I am however being hassled by the EA, they sent me a pack asking me to apply for a waste carriers licence, they have now sent a reminder stating they will be looking specifically for people who haven't yet replied to the original request for maney.

 

If I get the license will they then start to hassle me for where I put the chip/logs?

At the end of the day, it's another money raising gimmik. It's a right load of B0llocks

My interpreatation of that is Mrs Biggins garden is not agricultural therefore that exeption does not apply but

 

"Most businesses that only carry their own waste i.e. waste that

they have produced in the course of their business do not need

to register. The exception to this is any business that produces

and carries building or demolition waste."

 

We are not carrying building or demolition waste so do we need a license? Does a plumber need a license to get rid of an old boiler?

its important to remember just because its says exemption for ag doesnt mean that you dont have to do anything, there is no cost for the excepmtions but you still have to fill in the paperwork and send it to the EA!

Thats very true and be carefull filling in the paperwork, mistakes can be costly! There are 5 tree firms round here I know of with licences. If your being approached by the EA do things properly and supply them with evidence to fight your corner.

 

 

 

Its all down to interpretation this is just another thread going down the same line as the last one on the subject.
