Been cutting hedge alongside road put signs and cones out as you do, it was in a 30mph limit were some take no notice as it at end of village.

Soon is there a speed limit when you enter road works as been looking and can not find anything in highway code.

There is were signed on major roadworks.

Bit confused with the question there Paul.

 

Are you asking - is there a speed limit automatically in force because there are road works in effect? (And I'm guessing you're referring to B roads rather than dual carriageway/ motorway?)

 

If so, (I think) the answer would be "no", but the person licenced to carry out the works in the highway / highway margin would / should have stipulated within the application IF a speed restriction is required / requested, the authority granting the works permit would approve / authorise the speed change and the person doing SLG would implement the appropriate signage.

 

If what you are asking is, should people slow down when someone has put cones in the road (but they haven't got a licence / appropriate SLG) I think the answer would be - the duty to drive with due care and consideration is upon all drivers BUT, putting cones in the road could be deemed as a distraction / obstruction of the highway and could be deemed as a contributing factor if there were an incident.

 

Example: if cones in the road caused a vehicle to cross the centre line and crash with an on-coming vehicle, the 2 insurance companies will be looking for somewhere to off set the blame / cost. If someone has put cones in the road without a permit they are likely to be the target for the insurance, police & HSE.

 

It sounds like you'd like people to slow down as they pass your work site - perfectly reasonable!

 

But is the work site properly signed & licenced? If not, you could be on a sticky wicket if it goes bad.

If you are working on a road with a 30mph speed limit I don't think putting out road work signs alters the speed limit. From what I understand if you want to reduce the speed limit you will have to consult the police and council...

 

Chapter 8 of the Traffic Signs Manual is the bible of road works and temporary works signing. I've put a link below, however the document is hard to follow.

As others have said you could apply for a lower speed limit, with a (temporary) traffic regulation order, from the local highways streetworks department, it takes a longer time than booking your road space to work, as it needs advertising in papers, and local notices.

There is nothing stopping you using, slow signs, or rectangle yellow backed signs with black speed symbols, not legally enforceable, just advisable.
