  1. Dadio, your videos are very entertaining but for the wrong reasons; check out the guy in the yellow hat at 2.40 2nd video, clearly overriding the safety bar on the chipper. Very dangerous! H.S.E. would get involved over this side of the pond. Safety devices and guards are there for a purpose. Ten out of ten for what you are trying to do on here, hey it's more than I've done, but did you view these videos?
  2. Make them watch deal or no deal for a couple hours first.
  3. Always, always get authorisation in writing/email. Several times surgeons have been told to stop work when a mistake has been made in the planning dept, they make mistakes too. Over the phone is ok but back it up to cover yourselves, your guys and also the customer.
  4. You finally agree. "Anybody" It is not in any doubt that anybody, employee, boss, landowner, person just helping out doing a favour, anybody in the whole land could end up in the Crown court looking at an unlimited fine. Agreed, it's more likely that the owner or the tree company will be procecuted. (or both). Oops, except H.M.Queen Elizabeth 11 (she cannot prosecute herself).

  6. Sure the guy on the saw is liable, you are quite right, but the law say's "anyone" involved in cutting a protected tree. It's normally the owner of the the tree firm or both or anyone involved. For instance; a passer by helps to pull over the tree with his Landrover, or an employee is given good instructions, but disregards them and he is thinking of leaving the firm anyhow so he cuts TPO trees down by mistake. Both Liable.

  8. Err, that's good so if we all rely on Skyhuck's legal advice, anyone can cut a protected tree down and just say " it's ok I'm an employee". That would stand up in court for sure. Be realistic before you are so quick to give a single word reply of "Rubbish". Anyone involved in cutting a protected tree is liable, I think you will find. Where you are confused, it is common practice to take either the tree firm or the owner to court or both, only. However, there is nothing at all to stop them taking to court the guy with the saw in his hand whether he is a sub-contractor, a firm, one man and his dog or an employee or anyone under the sun involved. It just depends on how aggressive the L.A. are.
  9. It would not be a defence, to say you was employed to fell a tree or indeed that you did not know.
  10. Looks like you've confused the hell out of everyone by calling your customer "boss" . If I'm right, then the advice is always check the paperwork, and ring the Tree Officer to confirm it's legal.
  11. Look closely and you can see two linear lines. Nature rarely does straight lines. Hedge timmer exhaust directed straight into the hedge does.It's so closely trimmed the excess heat cannot escape and causes die back just like this. Also when it is trimmed the trimmer is a lot slower covering the face of the hedge when it is as dense as this adding to the overheating of the hedge.

  16. Pollard or fell the only choice. Never say any tree is safe or structually sound. Perfectly healthy trees lose limbs, fall, die back, die etc.
  17. Hey I'm new in here so here goes, Anyone else worried about retirement age being raised, so that when an employee reaches 65 (for a guy) you have to continue to employ him/her? Some people are clapped out by 50 working in this industry.
