With regard to the likelihood of prosecution angle it's worth remembering that the LPA has a duty under law to make provision for the preservation of trees and that there have been cases taken to the ombudsman against councils who have been too slack in pursuing that public interest duty.
  3. Yes he does. As has been pointed out above, the TO may be a consultee in the planning process and he may even have delegated authority to make TPOs but the planning inspector speaks on behalf of the secretary of state. National govt. representative trumps local govt. consultee every time.

  8. The number of individuals and the distance from parent tree. Its easier to compare the clustering of the dataset when both are plotted on the same axes. You may need to manipulate the y-axis values to drop the (rather conveniently contrived) order of magnitude out of the data. I could tell the OP how to do that but then where's the learning huh? (PS Excel will do it very simply.)
  9. I'm not sure the OP needs to consider the variables and control measures - he seems to have been presented with the data and simply needs to draw distinctions between it for his coursework. It might help to ignore the equation / best fit red herrings and take a look at the axis values...

Most of the Horse fly species in the UK don't bite like a mosquito as their proboscis (the pointy stabby drinky bit) is too short so they just cut a nice hole in your skin with their mandibles and lap at your emerging blood / plasma.   14. Dude, climb how you like. That said, nobody will tell you that this is a great idea because you want to change something neat, light and specifically designed for the job for something big heavy and general purpose. Then you want to stick some more jangly hardware in and attach a clunky gear heavy climbing system to it. It'll work and it won't be any less 'safe' but generally arb climbers tend to like minimal, simple systems. They're robust, trusted and there's less to go wrong or get in the way.
  15. There's specific and then there is nonsense. Appeal for non-determination is only sensible solution. Don't waste any more time on it - apply with as much information as you see fit, wait eight weeks and then appeal by written reps including an application for costs. It'll take longer but once you have a nice body of evidence (say three or four consents) showing that your specification is sufficient for PINS to determine then make a formal complaint under the LPA's complaint procedure regarding this obstructive practice. You might even like to demand an apology and additional compensation for the delays to your clients.   16. TPO conditions have the same weight as those applied to regular planning conditions. To that end, Circular 11/95 (thankfully not consigned to the DCLG bin yet) expects that that the condition be; 1. necessary; 2. relevant to planning; 3. relevant to the development to be permitted; 4. enforceable; 5. precise; and 6. reasonable in all other respects. I would strongly doubt that requiring TO supervision meets tests 1 & 6. Having the TO supervise you is fruitless - he/she can't prevent you from implementing the spec as written in the consent even if they don't like where the cuts are going. On that basis why should you suffer the hassle of scheduling a pointless visit.
  17. I don't recall there being any such ongoing costs for the PICUS when I had to make the business case for it when at the Council. We have an older Resi somewhere in the office - I don't think its ever been back to the fatherland...
  18. Any tree, conifers included, can be protected by a Tree Preservation Order or indeed by a planning condition, covenant and (if large enough) a conservation area.

  21. The end of dormancy is a heady blend of genetics and environment for sure. Genes get switched on and off by a plethora of triggers - climate, ambient light, nutrient availability, maturity, stress, disease; but you can add another layer of complexity to that when you know that they can be triggered by whether other genes have been triggered (which can be triggered by other genes being triggered, etc.). Recursive causation at its most opaque.
