Hi All,

 

Please could I have your advice on the following:

 

I have been asked to remove a large limb from a tree which overhangs a garden. The tree owner ( a very elderly lady) has given verbal permission to the potential customer. I have conducted all the normal checks and there are no restrictions.

 

My concern is that the TREE OWNER permission given are not in writing. The potential customers do not believe that they will get written permission from her as she has been difficult to raise, mainly due to older age etc.

 

So the main question is would you & should I pass on this job unless its all confirmed in writing?

I was under the impression you are legally allowed to cut back to boundary unless it is detrimental to the tree health.

Or was it permission to do the climbing? In which case I've always gone on verbal consent.

Thanks, yes overhanging limbs can be legally cut back and the local tree officer is happy. My point relates to not having anything in writing from the tree owner.

 

What are you planning to do that you need permission from the owner? :confused1:

verbal is ok but you need to offer to return the arisings. you may not climb or put a ladder in the tree without consent, this will need to be written if applicable.

What are the penalties for such a trespass?

The plan is to conduct a major limb removal prior to building works be carried out.

 

You don't need consent for that, its merely the exercising of a common law right

 

It would be wise to get a relative involved to smooth the way.
