We made the mistake of buying a car private a few years back, when under pressure to do so (one car fubar, had a hire car for the day to go car shopping, viewed this one at about 7pm as it was going dark...)

 

Dodgy as f... Turned out it was Cat C and had been clocked for about 40k miles. Cost us two grand, about another two grand in repair bills over the next 14 months (although to be fair, much of this was due to my Mrs planting it into a kerb at about 30mph and stuffing the drive shaft, wishbone, track rods etc). We then decided enough was enough and went to p/x it and got offered £400, ended up selling via eBay with full disclosure of the history - got a bit more than the p/x price but not much. Saw it about two years later so someone got use out of it :-(

 

Lesson learned - get a check done!

Also, quick bit of info for next time.

 

 

 

Even if you don't need finance on the vehicle if you say you do then all of this will come to light immediately.

 

 

 

The finance company will HPI the car for you, or the dealer will come out with the truth before you start filling in the application forms for the finance. Saves you £14.99

 

 

How does that save you money? A months interest on wherever you bought is gonna be more than that

I took it as by getting the finance company to run the checks you get to find out all the juicy details before putting your signature to it. Then pay cash, cheque or whatever.

I've got an ongoing one at the minute, bought the wife a 55 reg vauxhall vectra at the end of November as she wanted something more substantial for going up north to visit her family, had it about a month and starts rough idling, got aa out and diagnosed it as the dual mass flywheel breaking down, rang the dealer got the sorry mate sold as seen, trade sale etc bull, clutch and flywheel was quoted £550 on an £800 car, so quick bit of research remembering something I'd read regarding the new consumer act bought in last October and I ring him back to tell him he can no longer sell it as sold as seen and is his liability to sort it out, in the mean time put it into the garage to have the flywheel done so we can use it, £550 later it comes out running same as it went in along with a while list of other faults they found while it was in, so it's now sat on yard and looks like we're taking the dealer to court to get the money back as he's ignoring all correspondence.
You do have to feel a bit sorry for the dealer here if he sold it in good faith and had no idea the dual mass was on the way out. There is a reason why the car was £800 , about 5% of new price. It was a 10 year old car which is more liable to develop problems more than a newer one, its just a gamble really.We all want to buy a car as cheap as possible yet with this new consumer legislation, ( which applies to the sale of a used chainsaw by a tree surgeon as he is a trader ) unless the dealer has built in a safety net in the price, he cannot afford to sell a cheap used car, either scrap it or send it to auction. It was a 10 year old car which is more liable to develop problems more than a newer one, its just a gamble really.We all want to buy a car as cheap as possible yet with this new consumer legislation, ( which applies to the sale of a used chainsaw by a tree surgeon as he is a trader ) unless the dealer has built in a safety net in the price, he cannot afford to sell a cheap used car, either scrap it or send it to auction.

 

This is true however when it went in to have the flywheel done the garage told me it had been done recently but had been dropped and damaged so shouldn't have been fitted, it was also the salesman's threatening behaviour when I rang him about it that got my back up, under the new legislation it is the dealers responsibility to repair, refund or replace, wife's asked CAB and as he made no attempt to rectify the situation we can take him to court and for the money we paid for the car and the repair, we are also entitled to the cost of an alternative car we buy to replace it and could sue him for stress caused and hi threatening behaviour, I'm quite happy to give him the car back and have my money back but he is ignoring all contact.

Keep on and take him to court who will rule in your favour.. When the trader doesn't pay get the sherrifs involved.... The traders ignorance is no excuse. As a professional he should know better.... :thumbdown:
