Fence. Who owns it.

Owning the fence on the left is more common but not a fixed rule some people own the fence on the right, some own all, some own none. The property deeds are the only way to confirm it.

 

 

 

In a council or housing association owned property maintenance of fences, walls or any other form of boundary are almost always the landlords responsibility not the tenants (the exception being hedges which are always the tenants responsibility) although the tenant does usually have the right to maintain & replace them at their own expense if they are inclined to do so.

 

 

That'd be the key point (regardless of ownership) "if they are inclined to do so."

 

If they are not so inclined, establishing ownership would be academic.

 

Unless, having established ownership, you were to seek the owner's consent to replace at your own expense.

 

Might all be hopeless if the neighbour isn't willing to engage.

 

Neighbours - can't live with them, can't live with them!

Yep. Mine here state that looking from the road towards the front of the property the fence on the right is mine. In our last house it was the other way round.

 

However, the deeds are largely moot because without a (rare) positive covenant to enforce any action its all a bit toothless.

Found out its a very foggy subject. Unless on the deeds it seems no one owns it. If you put up a fence on the boundary and you pay for it its yours. The neighbour cannot fix to or paint without your permission. The council ain't much use so it looks like I'm paying for another fence again
